한국 화장품 문구를 그대로 번역하면 상당수가 의약품 표시가 됩니다. 경계선은 대부분 동사 하나에서 갈립니다.

한국 화장품 문구를 그대로 번역하면 상당수가 의약품 표시가 됩니다. 그 순간 제품은 화장품이 아니라 의약품으로 취급되고, 허가 없이 판매한 셈이 됩니다. 경계선은 대부분 동사 하나에서 갈립니다.

먼저 바로잡을 것 — 화장품 전용 허위광고 금지 조항은 없습니다

​

업계 자료에 "식품의약품법 제19조·제20조가 화장품 허위광고를 금지한다"는 서술이 돌아다니는데 틀렸습니다. 법 제1부의 구조는 식품(4~7), 의약품(8~15), 화장품(16~18), 의료기기(19~21)입니다. 제19·20조는 의료기기 조항입니다.

화장품 항에는 제9조(의약품 허위표시 금지)에 대응하는 화장품 전용 조항이 존재하지 않습니다. 그래서 규제의 축이 다른 곳에 있습니다.

  • 치료적 표시를 하면 제품이 의약품으로 재분류되고, 그때 제9조가 적용됩니다

  • 화장품 규정 제21조 — 근거자료 보유 의무

  • 포장·표시법 제7조 — 허위·오인 표시 금지

회사 웹사이트가 명시적으로 포함되어 있다는 점에 주목하십시오. 라벨만 정리하고 상세페이지를 방치하면 소용이 없습니다.

이 문서는 법이 아닙니다. 문서 스스로 "do not have the force of law"라고 밝히고, Ad Standards도 정부기관이 아니라 업계 자율규제 기구입니다. 1992년 Health Canada가 화장품 광고 사전심의 기능을 이관한 것이 이 문서의 무게를 만들었을 뿐, 법적 구속력의 근거는 아닙니다.

심의 자체도 의무가 아닙니다. Health Canada는 "Preclearance of advertising material by arms-length agencies remains voluntary for industry, but Health Canada strongly recommends it"라고 명시합니다. 다만 방송은 매체가 Ad Standards 승인번호를 요구하고 TV는 thinktv 승인이 추가로 필요하므로 법적 의무가 아니어도 실무상 관문입니다. 한국 브랜드의 주 채널인 이커머스 상세페이지와 SNS는 사전심의 대상이 아니라 사후 단속 영역입니다.

핵심 문법 — look / appear / visibly

​

외관 서술로 한정하면 화장품, 실체 변화를 단언하면 의약품입니다. 항노화가 가장 명확한 예입니다.

​

  • 화장품 — "Diminishes/Reduces the look or the signs of aging", "Smoothes wrinkles", "Wrinkles appear/look reduced", "Skin looks visibly younger/revitalized/brightened"

  • 의약품 — "Prevents photoaging and/or related damage", "Provides the effect of a medical/surgical procedure"

한국어 "주름 개선"을 improves로 직역하면 위험합니다. look 또는 appear를 반드시 넣어야 합니다.

​

보습 — 수식어 하나 차이

​

​

  • 화장품 — "Heals dry skin", "Repairs dry skin", "Replenish/Protect the skin’s moisture barrier"

  • 의약품 — "Heals (unqualified)", "Repairs (damaged) skin", "Repairs the skin’s moisture barrier"

​

"heals dry skin"은 되고 수식어 없는 "heals"는 안 됩니다. 장벽을 protect·replenish하는 것은 되고 repair하는 것은 안 됩니다. 한국 브랜드가 즐겨 쓰는 "장벽 재생·복구"가 정확히 후자입니다.

미백 — 가장 위험한 영역

치료적: "Any impression or reference to skin de-pigmentation"
치료적: "Eliminates age spots" / "Prevents new spots from appearing"
비치료적: "Reduces the look of age spots"

색소 탈색을 시사하는 순간 치료적입니다. 참고로 치아 whitening은 허용되지만 이는 치아 전용 항목이고 피부에 유추 적용할 수 없습니다.

​

Health Canada도 skin whiteners를 화장품·의약품 경계 제품의 대표 예시로 명시합니다. 한국의 "미백 기능성 화장품"은 캐나다에 대응 카테고리가 없습니다.

여드름 — 정의가 넓습니다

​

비치료적: "Cleanser for acne-prone skin" / "Covers blemishes/acne" / "Improves the look of acne scars"
치료적: "Heals/Prevents/Stops/Treats acne" / "Clears skin (acne)" / "Anti-blemish"

각주가 결정적입니다. 블랙헤드와 면포가 여드름 정의에 포함되므로 "블랙헤드 제거", "트러블 케어"를 영어로 옮기는 순간 치료적 영역입니다. anti- 접두사 자체가 위험하다는 점도 함께 보십시오 — "Anti-blemish"가 치료적으로 분류되어 있습니다.

​

반면 모공 표현은 비치료적 열에 있습니다 — "Deep cleans pores", "Unclogs/Tightens pores", "Makes pores smaller" 세 가지 모두 원문 Skin Care/Makeup 표의 비치료적 칸입니다. 블랙헤드는 여드름 정의에 묶여 치료적인데 모공은 허용되는 비대칭이므로 한 문장에 섞어 쓰지 마십시오. "모공 속 노폐물까지 제거해 트러블을 잡아준다" 같은 한국식 카피는 앞부분만 살고 뒷부분에서 걸립니다. 같은 표의 치료적 열이 "세포·조직 수준의 작용" 언급을 막고 있다는 점도 함께 보십시오.

탈모 — 대응 카테고리가 없습니다

  • 화장품 — "Strengthens hair", "Thickens hair", "Revitalizes hair", "Removes loose dandruff flakes"

  • 의약품 — "Prevents hair loss/thinning", "Prevents/Treats alopecia", "Stimulates hair growth", "Any effect on living tissue (e.g. hair follicles)"

모근·모낭을 언급하는 순간 마지막 항목에 걸립니다. 비듬은 "느슨한 각질을 씻어낸다"까지만 화장품이고, "비듬 방지·제거"는 의약품입니다.

재생 · 항염 · 항산화

​

  • 재생 — "Any reference to action at a cellular level (living)", "Reference to action on tissue/body/cells", "Any reference to repairing damage"가 모두 치료적. 세포·조직 재생을 함의하는 모든 표현이 여기 걸립니다

  • 항염 — "Any impression or reference to pain or irritation"이 치료적. 항염 주장은 치료적으로 취급될 개연성이 높습니다

  • 항산화 — 제품 보존 목적일 때만 화장품. 피부에 대한 항산화 효과, 특히 "free radical scavenging"은 치료적으로 명시

성분 표현도 주의해야 합니다. 한국의 "유효성분"을 그대로 옮긴 "active ingredient"가 그 자체로 치료적 표현입니다.

허용되는 표현

​

​

  • "Dermatologist tested" — 허용. 다만 실제 시험이 있었고 피부과 또는 안과 전문의가 관여했어야 합니다

  • "Organic" — 허용. 단 인정된 유기농 인증 기준을 충족해야 합니다

  • "Hypoallergenic" — Health Canada는 "not a legal or a scientific term"이라고 규정합니다. 별도 입증 지침은 없지만 화장품 규정 제21조를 통해 근거 보유 의무가 발생합니다

"natural"과 "organic"은 Health Canada가 아니라 Competition Bureau(캐나다 경쟁당국) 소관입니다. 따라서 경쟁법이 적용됩니다.

​

근거자료는 광고 전에 있어야 합니다

​

​

"No manufacturer shall make any claim on a label of or in an advertisement for a cosmetic respecting either of the following, unless the manufacturer has evidence that validates the claim: (a) the ability of the cosmetic or any of its ingredients to influence the chemistry of the skin, hair or teeth; or (b) the formulation, manufacture or performance of the cosmetic that would imply that the user of the cosmetic will not suffer injury to their health."

수치 클레임은 경쟁법이 더 엄격합니다.

"2주 만에 주름 32% 감소" 같은 표현이 여기 정면으로 걸립니다. 시험이 광고보다 먼저 있어야 하고, 사후에 붙이는 방식은 요건을 충족하지 못합니다.

한국에서 만든 콘텐츠도 대상입니다

​

​

"it is not necessary to prove that ... (b) any member of the public to whom the representation was made was within Canada"

광고를 본 소비자가 캐나다에 있었을 필요가 없다고 명시합니다. 한국에서 제작·게시한 콘텐츠도 사정권입니다.

​

인플루언서는 Competition Bureau가 별도로 다룹니다.

​

세 가지 함의가 있습니다. 인플루언서가 한 말에 브랜드가 책임을 지고, 대가관계를 공개해야 하며, 후기는 실제 경험에 기반해야 합니다. 한국식 체험단 대량 후기 운영을 그대로 이식하면 문제가 됩니다.

실질적 억지력은 경쟁법 쪽에 있습니다

​

식품의약품법 벌금은 낮습니다 — 약식기소 초범 최대 500달러, 정식기소 최대 5,000달러. 실제 리스크는 판매중지와 리콜, 그리고 경쟁법 제재입니다.

​

Health Canada의 집행 수단은 판매중지, 소비자 경보 게시, 자발적 리콜 요청 등입니다. 이미 유통된 재고가 회수 대상이 되므로 손실은 벌금과 비교되지 않습니다.
